Article 10. Nature of the Central System of Records for Animal Protection

1. The Central System of Records for Animal Protection constitutes a unique information system, whose fundamental objective is to serve as support to the different public administrations in the exercise of their powers regarding the protection and rights of animals.

2. Its scope extends to the entire Spanish territory, without prejudice to the provisions of the international treaties signed by Spain on this matter.

3. The main legal basis of the treatment, in accordance with the objective and purpose of this law, is the fulfilment of the mission of public interest consisting of procuring the protection and guarantee of the rights of animals, in accordance with the provisions of letter e) of the first section of article 6 of Regulation (EU) 2016/679 of the European Parliament and of the Council, of April 27, 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of these data.

4. Personal data subject to processing to achieve the purposes of public interest provided for in this law are all those that are essential to procure the protection and guarantee of the rights of animals. These data may not be subsequently processed in a manner incompatible with said purposes.

5. The corresponding ministerial department and the autonomous communities are responsible for the processing of the data contained in the records, in accordance with their respective areas of competence.

6. This system, made up of the information contained in the records listed below, is intended, in each case:

a) Registration of animal protection entities: the registration of associations or foundations whose statutes empower them to carry out any activity whose purpose is the protection of animals.

The purpose of this registry is to include information on the entities that carry out activities related to animal protection and welfare throughout the national territory, with the aim of facilitating the adoption process of companion animals with maximum guarantees, knowing the number of animals given in adoption, the state of saturation of the protective entities, as well as their geographical distribution, and obtain reliable data on animal abandonment and status of feline colonies, with the ultimate goal of establishing the necessary protective measures.

To do this, this record will include the name of the entity, business name and postal address and identification data of the natural person representing said entity.

b) Registry of Animal Behaviour Professionals: the registration of any person who carries out professional activity aimed at the education, training, behaviour modification or similar of animals included in the scope of application of this law, persons with veterinary training accredited in animal behaviour, people with a Bachelor’s or University Degree with complementary training in Ethology and those people who hold at least the Certificate of Professionalism in Basic Training and Canine Education (SEAD0412), which accredits the professional qualification SEA531_2 basic training and canine education, included in the National Catalogue of Professional Qualifications, in their corresponding categories without prejudice to others that may be developed by regulation.

The purpose of this registry is to keep a record of the professionals who are engaged in these activities, to avoid situations of bad practices that have an impact on the health of the animals or the use of unapproved training methods. To do this, this register will include the identification, academic and professional data of the applicants to verify their qualifications.

In addition, in order to register in this registry, it will be necessary to prove the degree that qualifies for the exercise of these activities, in the manner determined by regulation.

c) Registry of Companion Animals: the registration of any companion animal that, in accordance with the provisions of this law or the regulations of the autonomous communities and cities of Ceuta and Melilla, have a mandatory identification system, as well as the identity of its owners or managers.

The purpose of this registry is to facilitate the identification and traceability of any abandoned animal anywhere in the national territory, regardless of the autonomous community or autonomous city in which it was registered.

To do this, this record will include the identification and health data of the animal, if they carry out activities associated with human activities, such as hunting, employment by the Security Forces and Bodies or grazing activity, together with the identifying data of the owner or manager.

d) Registry of Companion Animal Zoo Nuclei: the registration of companion animal zoo nuclei in the terms defined in this law.

The purpose of this registry is to keep a record of the establishments that keep pets permanently or temporarily.
To do this, this record will include the identification data of the person who owns the zoo.

e) Register of Companion Animal Breeders: the registration of persons responsible for the activity of breeding companion animals.

The purpose of this registry is to have proof of the people who are dedicated to the breeding of companion animals, in the terms established in this law, both for the purpose of commercial breeding and for punctual breeding or others that are developed by regulation. To this end, this registry will include the identification data of the breeder and its breeding specimens.

7. The natural persons whose personal data is kept in these records will be informed in this regard in accordance with current regulations on the protection of personal data.

8. The registration in these registers will be carried out ex officio based on the responsible declarations presented by the interested parties. Said responsible declarations will allow the start of the activity from the day of its presentation, without prejudice to the powers of verification, control, and inspection that the public administrations have attributed.

9. Regulations will determine the treatment of the information contained in the records that are part of the System, as well as the conditions of access to said information.
