Article 23. Obligations of public centres for animal protection

1. Public Animal Protection Centres are obliged to:

a) In the case of dogs, cats and ferrets, sterilise the animal prior to its adoption or sign a sterilisation or non-reproduction commitment if they were not old enough or in sufficient condition to perform the surgery, according to veterinary criteria. They will also be obliged to sterilise animals of other species, whenever this is feasible according to veterinary criteria.

b) Comply with the minimum veterinary requirements for the delivery of the animals and the corresponding minimum stipulated treatments that will be established by regulation.

c) Deliver the animals with an adoption contract and identified according to current regulations.

d) Ensure adequate welfare conditions and hygienic-sanitary conditions of housed animals, suitability of spaces, security measures, staff training, animal registration and veterinary care.

e) Possess the corresponding authorisation or license to constitute a legally established zoological nucleus.

f) Have volunteer programs and/or collaboration with animal protection entities, in accordance with current legislation on volunteering and associationism.

g) Participate in the awareness programs provided for in article 18.

h) Promote the responsible adoption of animals.

i) Have adequate spaces for housing community cats that, due to exceptional circumstances, have not been able to be returned to their original location. The characteristics of these spaces and the exceptional conditions will be developed according to the regulations.

j) Identify and register, at the moment of their entry into the centre, all those animals that are collected without carrying identification.

k) Follow up on the animals given up for adoption or fostering, verifying that the welfare conditions and hygienic-sanitary conditions of the animals are met.

l) Have an animal collection service with full time availability.

2. Without prejudice to the sanctions provided for in title VI, public animal protection centres will be directly responsible for breach of the provisions of letter a) of article 27. In the case of concerted public animal protection centres, said breach will entail in all case the resolution.

3. Public animal protection centres or those that have conventions or agreements with public administrations, will be obliged to house and maintain, within the limits of the capacities of each centre, the animals for which mandatory sanitary quarantines are ordered. by the competent authority in animal health or public health.
