Article 42. Prohibitions
The following actions are prohibited in relation to feline colonies:
1. The sacrifice of cats, except for disorders that compromise the cat’s health in the long term or in the exceptional cases allowed in this law for the sacrifice of companion animals. The sacrifice will be duly certified and carried out by a veterinary professional.
2. The confinement of cats not socialised with humans, in animal protection centres, residences or similar, except for the necessary actions in the intervention processes of animals from the colonies for their treatment or relocation.
3. The abandonment of cats in the colonies, whatever their origin.
4. The release of cats in colonies other than the one of origin.
5. The hunting use of cats.
6. The removal of community cats from their colony, with the following exceptions:
a) Sick cats that cannot continue to fend for themselves in their usual environment and territory. In these cases, the most appropriate options for the cat will be assessed by a professional veterinarian, always putting the animal’s quality of life criteria first.
b) Cats totally socialised with the human being that are going to be adopted.
c) Kittens of socialisation age that are going to be adopted.
7. The relocation or displacement of community cats, with the exception of cats whose location in the wild:
a) Is incompatible with the preservation of their integrity and their quality of life.
b) It supposes a negative impact for the conditions of biodiversity in protected natural spaces and in the spaces of the Natura 2000 Network.
c) It supposes a negative impact for the protected fauna.
d) It poses a risk to the health and safety of people.
8. Withdrawal actions for relocation or displacement in another space will preserve the well-being of community cats and feline colonies and will be carried out under veterinary supervision and prior mandatory report from the competent body of the autonomous community on compliance with the protection conditions. where the situations described in letters a), b) and c) will be assessed, the need for removal or displacement will be justified and the most appropriate options for the cats will be assessed and planned. In the case of letter d), the assessment of the situation described will be carried out by the competent body in the matter.
