Article 44. RAC-type animal protection entities

RAC Type entities are those that carry out activities of rescue, rehabilitation and search for adoption of companion animals in situations of abandonment, mistreatment, helplessness or other situations. These entities must comply with the following obligations:

a) Submit to the competent Administration an annual report that includes a financial summary of its activity, the human resources employed and the training activities provided.

b) Have a record of animals under guardianship and given up for adoption.

c) In the case of dogs, cats and ferrets, sterilise the animal prior to its adoption or sign a sterilisation commitment if they were not old enough to perform the surgery, according to veterinary criteria. They also have the obligation to sterilise animals of other species, whenever this is feasible according to veterinary criteria.

d) Comply with the minimum veterinary requirements for the delivery of the corresponding animals and the minimum treatments stipulated in relation to mandatory sterilisation, identification, deworming and vaccination.

e) Deliver the animals with an adoption contract in which the rights and obligations of both parties are clearly specified.

f) In the event that they work with shelters, the rights and obligations of both parties must be contractually reflected.

g) Identify the animals according to current regulations.

h) In the case of having a protection centre to house the animals, they must have the corresponding authorisation or license to constitute a legally established zoological nucleus.

i) Ensure the well-being and hygienic-sanitary conditions of the housed animals, adaptation of spaces, security measures, staff training, animal registration and veterinary care.

j) Be the holder of a valid civil liability insurance that covers their activities.

k) At least one member of the board of directors or governing body of the entity must be in possession of the degree determined by regulation.

l) Have administrative authorisation for the collection of abandoned or lost animals in the territorial area where it is carried out.
