Article 59. General conditions of transport

1. Without prejudice to the application of specific legislation on the matter, when animals are transported, the person responsible for them must guarantee compliance with the following general conditions:

a) That the animals are in a condition to carry out the planned trip.

b) That all the physiological and ethological needs of the animals are met.

c) That the means of transport or container, even if it is a private vehicle, have an air conditioning and ventilation system in order to keep the animals within their comfort range, arranging the containers so that all specimens have same climatic and ventilation conditions. The means must be adequate based on the species, size and physiological needs of the animal, having enough space to avoid overcrowding, guaranteeing road safety and the safety of the animals during transport.

d) That the means of transport and the loading and unloading facilities are conceived, built, maintained and used properly, so as to avoid injuries and suffering to the animals and guarantee their safety.

e) That the animal is protected from adverse conditions, and, in particular, it will ensure that it is not left uncared for in the means of transport or container in such conditions that could be detrimental to its safety or health.

f) That the animals are provided with water, food and rest periods at sufficient intervals and in quantitatively and qualitatively adequate conditions for their species and size.

2. All professional animal transport activities must have a contingency plan in the event of accidents or unforeseen events that may affect their health or integrity.
