Article 63. Scenes of simulated abuse in filming and performing arts

1. The representation or filming of scripted scenes with animals for theatre, film or television or other audiovisual media or performing arts or photo sessions for advertising purposes that involve scenes that reflect cruelty, mistreatment, suffering or death of the same must be carried out, in all cases, simulated, not being able to suppose situations of extreme stress or excessive physical effort for the animals and without the products and means used causing any harm to the animal.

2. The filming or representation of the scenes of the previous section will require the prior authorisation of the competent body of the autonomous community, as well as the registration of all the data of the animal, filming or representation times and the data of the persons responsible for guaranteeing its welfare. In all the filming, the presence of veterinarians specialised in the species that will be used (whether domestic or wild) must be accredited, guaranteeing and attesting that there was no suffering in the animals used.

3. In the exhibition of the filming, it must be expressly stated that the scenes referred to in this article are simulated, without causing any damage or suffering to the animals.

4. Notwithstanding the foregoing, in film, television, internet, photographic, artistic or advertising productions, as well as any other audiovisual media, technological alternatives that do not involve the use of real animals will be used whenever possible.
