Article 77. Accessory measures

1. The fine may be accompanied by one or more of the following accessory sanctions, depending on the nature of the acts constituting the infraction:

a) The intervention of the animal and its transmission to an animal protection centre or to that determined by the competent authority.

b) The withdrawal of weapons and the licences or permits corresponding to them.

c) The confiscation of the assets, means or instruments with which the offence was prepared or executed and, where appropriate, of the effects arising from it.

d) The temporary suspension of licences, authorisations or permits from six months and one day to two years for very serious infractions and up to six months for serious infractions, in the field of matters regulated by this law.

In case of recidivism, the penalty may be from two years and one day up to six years for very serious offences and up to two years for serious offences.

e) The closure of the premises or establishments, from six months and one day to two years for very serious infractions and up to six months for serious infractions, in the field of matters regulated in this law. In case of recidivism, the penalty may be from two years and one day up to six years or the definitive closure of the establishment for very serious infractions and up to two years for serious infractions.

f) Disqualification from carrying out activities related to animals, and possession of animals, for a maximum period of five years for serious offences and from five to ten years for very serious ones.

g) Withdrawal or non-granting of subsidies or aid in the matter of this law for a maximum period of five years for serious infractions and from five to ten years for very serious ones.

h) The obligation to take re-education or training courses in welfare, animal protection and animal rights.

i) Carrying out work for the benefit of the community.

2. If the sanctioned acts have been carried out through the use of weapons or explosives, the investigating body will send the corresponding information to the Guardia Civil, so that, in accordance with the legislation on protection and citizen security and the regulations on weapons, it adopts the appropriate decisions.

3. Minor infringements may entail the imposition of the accessory sanctions indicated in sections h) and i) of the first section of this article.

4. Serious and very serious infringements may entail the imposition of any of the accessory sanctions indicated in the first section of this article.
